Acts Against the Constitution are Void

VOID.

That’s how many leading founders and old revolutionaries described acts that go beyond the powers authorized by the Constitution.

James Otis Jr. told us that an “act against the Constitution is void.”

Thomas Jefferson wrote “that whensoever the General Government assumes undelegated powers, its acts are unauthoritative, void, and of no force”

Roger Sherman wrote that “all acts of the Congress not warranted by the constitution would be void.”

Even Alexander Hamilton repeatedly got in on this important message. Here, from Federalist 78:

There is no position which depends on clearer principles, than that every act of a delegated authority, contrary to the tenor of the commission under which it is exercised, is void. No legislative act, therefore, contrary to the Constitution, can be valid.

When Hamilton sounds better than most federal politicians alive today, you gotta know we’re in big, big trouble.

Void.

Living under the largest government in history – that perfectly describes almost every federal act on the books today.

But they’ll never become void in practice by merely saying so. It takes people who “understand their rights and are disposed to defend them”

I covered this in much more detail on this classic episode of the Path to Liberty podcast from our archives, which you can find here:

On that page, you’ll also find links to the source documents from Otis, Jefferson, Sherman and Hamilton that I mentioned above. Plus more from Thomas Paine, Oliver Ellsworth, St George Tucker, James Iredell, George Nicholas and more.

Here’s the bottom line that we all need to understand.

As Samuel Adams put it – “all might be free if they valued freedom and defended it as they ought.”

Like the “Father of the American Revolution” told us – it takes both education and a love of liberty – plus the backbone needed to defend it against all dangers, whether the government likes it, or not.

This is the kind of essential information we work hard to get out to more people every single day of the year. There’s absolutely nothing that helps do this more than the financial faith and support of our members. Join us today and help us take a stand for the Constitution and liberty!
